Abstract

The concept of equality is the corner stone of our constution. Equality in broad sense include equality to all parties of society or for that matter parties of crime as well. The concept of fair trial was one of consideration before framing of criminal procedure code. The victim is one of the essential pillar of our criminal justice system. But in contemporary sense this pillar is subject to harassment, at every level whether it is the actual stage of commission of crime, before investigation, during investigation, or at trail stage by way of frequent adjournments and other ancillary things more so often when the victim is women she is subject to illogical and humiliating questions in the name of cross exazmination.The concept of restorative justice is growing at international level. The restorative justice emphasises on the importance of elevating the role of crime victims, and community members, holding the offender directly accountable to the people they have violated. Restoring the material and emotional losses of victims, and providing a range of opportunities for dialogue, which can be basis of community safety. Now it’s the time that victims need to be moved from a forgotten actor to a key player in the criminal justice system. The authors of the paper tries to find out concept of restorative justice in different parts of the world and particularly under the criminal procedure code of india.at the end of the paper the authors has provided some suggestion in order to make the restorative justice more effective and provide it more teeth’s so that its fruits help community at large.
